If your civil rights are in your underwear, you’ve got more problems than any legal system can handle, brother. I smoke a pack a day and I understand public smoking bans, because it really bothers a lot of people to be faced with cigarette smoke in an area everyone has to use whether they smoke or not. Orderly conduct is a mutual and basic expectation for the public, it is how you and I expect each other to behave without knowing one another. The dis con statuate for Oregon states that you can be charged with disorderly conduct if you are causing a public annoyance; it also has a provision for unreasonable noise, so I guess depending on what you had for lunch that day, it fits…
It is not a breach of civil liberties. Many people are so out of control and useless on their own behalf that they have to be told what not to do so they actually behave in a somewhat reasonable manner. It’s a waste of energy to get upset or to even equate this as violating your liberties the forefathers gave you.
